Terms of Service

Please read these Terms of Service ("Terms") carefully before using questly. These Terms are between you and Questly. By accessing or using the service, you agree to be bound by these Terms. If you do not agree, do not use questly.

1. Acceptance of Terms

By creating an account or using questly in any way, you confirm that you are at least 16 years old and have the legal capacity to enter into this agreement. questly is intended for solo freelancers and independent service providers using the app for their own work.

2. Description of Service

questly is a task, client, project, focus, and time-tracking platform designed to help solo freelancers organize their work. We provide tools for task capture, client and project context, browser reminders, advanced filters, daily planning, focus sessions, and time entries. Features vary by plan.

3. Account Registration

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. Notify us immediately at support@usequestly.com if you suspect unauthorized access to your account.

4. Subscriptions and Billing

questly offers a Free plan, a limited Founding monthly plan for early customers, and Pro monthly and annual plans. Paid plans start with a 7-day trial and are billed in advance through Stripe on a monthly or annual basis after the trial unless cancelled.

• The Free plan includes up to 3 clients, 3 projects, 50 active tasks, task capture, basic planning, and a basic dashboard
• Founding and Pro plans include unlimited clients, projects, and tasks, browser reminders, advanced filters, and full focus and time history
• Subscriptions automatically renew unless cancelled before the renewal date
• You can manage payment methods, invoices, plan status, and cancellation from the Stripe billing portal in your account settings
• If you cancel, paid access continues until the end of the current billing period unless Stripe or we process a different cancellation timing
• Refund requests for accidental renewals or first charges are reviewed when you contact support@usequestly.com within 14 days; otherwise fees are non-refundable except where required by law
• We reserve the right to change pricing with 30 days' notice to existing subscribers
• Payment processing is handled by Stripe and subject to Stripe's terms

5. Acceptable Use

You agree not to use Questly to:

• Violate any applicable laws or regulations
• Infringe the intellectual property rights of others
• Upload or transmit malicious code or content
• Attempt to gain unauthorised access to our systems or other users' accounts
• Resell or sublicense the service without our written consent
• Scrape, crawl, or otherwise extract data from the service in bulk

We reserve the right to suspend or terminate accounts that violate these rules.

6. Your Content

You retain ownership of all content you create in questly, including tasks, client records, project records, notes, time entries, and focus history. By using the service, you grant us a limited, non-exclusive license to store and process your content solely for the purpose of delivering the service.

You are solely responsible for the accuracy and legality of your content. We do not review user content and have no obligation to do so.

7. Intellectual Property

questly and its original content, features, and functionality are owned by Questly and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform without express written permission.

8. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, upgrades, or experience outages from time to time. We will endeavour to provide advance notice of planned downtime where possible.

9. Disclaimer of Warranties

questly is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free or that defects will be corrected.

10. Limitation of Liability

To the fullest extent permitted by law, Questly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your access if you breach these Terms, with or without notice. Upon termination, your right to use the service ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the app at least 14 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Slovakia unless mandatory consumer or business laws require otherwise. Any disputes shall be resolved in the courts of competent jurisdiction. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
